Never giving up on his clients, Marshall was able to get possession of his client’s phone, thereby gaining crucial evidence directly contradicting the new alleged victim’s account of events. Utilizing this evidence, Marshall filed an over 300-page bail motion dissecting each and every account of the new alleged victim’s allegations which resulted in his client’s release and him being reunited with his young child. But that was not the end of the story — using what he was able to show at the preliminary hearing by way of his meticulous cross-examination of the witnesses, Marshall was able to show the District Attorney in the first case all of the problems of proof regarding the sexual assault allegations. The result was an offer that resulted in no additional jail time and no duty to register as a sex offender. However, the plea agreement was so favorable to Marshall’s client that the judge at sentencing almost rejected the agreement. Again, never giving up, Marshall wrote an almost 200-page memo outlining his client’s mitigation, problems of proof in the case, and multitude of errors contained in the probation report. As a result, not only did the sentencing judge compliment Marshall’s memo, but agreed to sentence his client in accordance with the agreement. As a result, Marshall’s client was able to stay out of jail, keep his job, and, most importantly, be home with his son.
